Halloween is known for tricks, terror and treats. However, hapless party hosts, pumpkin patch proprietors and corn maze meanderers have haunted courts. Click through to read about 5 claims lawsuits that would send a shiver down the spine of any agent or broker.



Haunted Houses

The Haunted House Assn. estimates that more than 2,000 haunted attractions operate each year. This seasonal industry leaves a lot of room for disgruntled customers, so owners beware: Insure your attractions properly, or you're in for a scare.

In the case of Deborah Mays v. Gretna Athletic Boosters Inc., defendants operating a haunted house at the Mel Ott Playground in Gretna, La., were taken to court by the plaintiff, Mays, who became frightened when an employee jumped out at her. Mays ran into a cinderblock wall covered with black fabric and needed two surgeries to repair her broken nose.

The court found the defendant had "no duty to protect Mays from her reacting in Cybizarre, frightened and unpredictable ways'" because that is the natural and expected reaction to haunted houses. Duty of care owed to haunted house patrons is different because courts recognize they are intended to scare people and accomplish that end by producing an environment with limited lighting and scary surprises.

Maze of Litigation

With the holiday's propensity for themes of bones, blood and gore, it's no surprise that Halloween accidents can be dangerous or deadly.

In the case of Durmon v. Billings, the plaintiff met with a figure dressed as Jason Voorhees from the popular horror film "Friday the 13th" while walking through the defendants' corn maze. The character approached "Jason," who wore a costume and mask, and wielded a running chainsaw above his head. The plaintiff attempted to run away, but fell and broke her leg.

In the lawsuit, the plaintiff charged the maze owners with negligence for the muddy condition of the field and for allowing "Jason" to use an instrument that could have harmed her. The court found that, upon entering the maze, the plaintiff had paid to be frightened and that the maze's condition was obvious. Therefore, the defendants were not responsible from protecting her from Jason.

If the defendants had failed to mention to their insurers that they operate a corn maze on their land, any accident occurring there would not have been covered by the insurance policy. If found at fault for an accident, the defendants would be solely responsible for paying the settlement.

Costume Coverage

Gone are the days when a sheet with two holes for eyes constituted a costume. Those trying to circumvent the expense of Halloween by making their own costumes should use common sense around hazards like candles or fireplaces and be sure to read all manufacturer warnings.

Susan and Frank Ferlito attended a Halloween party dressed as Little Bo Peep and one of her sheep. Frank lit a cigarette and ignited his sheep costume, which was constructed from Johnson & Johnson cotton balls. A jury found the couple 50 percent at fault, but still awarded the Ferlitos a combined $625,000 in Ferlito v. Johnson & Johnson.

The district court granted Johnson & Johnson's motion for judgment notwithstanding the verdict. On appeal, the court affirmed the district court's decision to set aside the jury verdict, and noted that cotton is a "simple product with all its essential characteristics apparent, including flammability." Failure to warn was not found to be proximate to the cause of the injuries the plaintiff sustained and he had not testified that he would not have used the product if there had been a warning.



Risque Risks

Issues can arise when adults wear costumes--especially those considered to be provocative--to work. Sexual harassment and other actions that fall under behavior related to hostile work environments have become prevalent in employment law disputes.

A female sales employee filed a sexual harassment lawsuit when a male manager made lewd comments about her doctor costume. He unbuckled his pants, motioned to his groin, and said, "Here, Doctor. It hurts here." The defendant was ordered to pay a civil penalty of $50,000 and related attorney fees for the plaintiff at the conclusion of Devane v. Sears Home Improvement Products Inc.

Party Precautions

Megan Duskey went to the "Haunted Hotel Ball" hosted by Palmer House Hilton in Chicago in 2010. Instead of a fun night with friends, Megan fell four floors to her death after attempting to slide down a railing and suffering head trauma.

Her parents filed suit in July of this year, alleging negligence on the part of Palmer House Hilton as well as the event companies hosting the party. The suit claims that the hosts and hotel allowed guests to consume unlimited amounts of alcohol and failed to provide adequate security. The plaintiffs seek more than $500,000 in compensation for their daughter's death.

Scary Maze Game

What's original fascinating about Scary Maze Game To start with, SMG is not even a game... It is one of the most original internet pranks ever made or rather the most original. At first sight, SMG is no different from any other flash maze game, there is a maze and a small object player has to bring to the exit. Any player can get past the level one without an effort; next level however is more challenging and considerably harder. Player needs to focus on the task in order to succeed. And when he/she is focused enough that is when "it happens".

There are many versions of scary maze games, there's even a mobile version (for iOS and Android) but SMG is not effective enough on mobile phones since the scary effect largely depends on speakers (should be on high volume). There are also games like Scary Maze that don't look like the ones people are used to, and the ones that don't advertise the word "scary", which is good since you can easily prank people who have had experience with SMG in the past. You can however, forget about the game, there are only 2-3 levels (depending on game edition) just enough to make you relax, concentrate on the game, after "it happens" game is over. Except some editions like Scary Maze Game DX, if you really like SMG, can't live without it, DX version has more levels and without scary effect.

Don't Look Back

An emotional 8 bit puzzle / adventure game with a very powerful ending (reminds the Orpheus adventure in underworld from Greek Mythology, actually, it is a story of Orpheus and Eurydice). The game is old but not as old as you may think, it's been published by Kongregate website in 2009. To actually feel strong emotions about 8 bit game, is something we don't see every day. If you have played "One and One Story" and liked it, you'll definitely going to love this one. State of art game, flawless story, and musical background, difficult but in a perfect doze.

Best thing about the game is the atmosphere, how it makes you feel: sometimes you just want to let go the keyboard and enjoy the dark rainy sky, the music. The ending is very sad and shocking at same time, but everything makes sense, more than it does in any other game you've played before. While the game is enjoyable and lovable, it is also incredibly infuriating, but don't give up too soon, it worth going through hell to see the game finale.

Don't Look Back is a work of art, a philosophical game that makes you feel mixed emotions: the anger, sadness, intrigue and love. Excellent interpretation of the story from the Greek Mythology, the real work of art.



Karoshi Salary Man

99.99% of all games share the same concept: A hero saves the world, or at least saves himself, or dies trying. But what about the 0.01%? Tiny 0.01% is called Karoshi, salaryman with one purpose only, to die! The point of the game, or rather the goal of each level in the game is to die. How's that for original? Looking for ways to die instead of saving your a$$... Like whenever you see a door with an Exit sign, you ignore it, because if you go through that door the game is over.

Let's ignore the fact that Karoshi game has an extremely unusual premise; the game process itself is also very interesting: puzzles are intelligent and original, sound effects are fitting, and more importantly the game is fun. Action-platformer game Karoshi Salaryman is not just a show, 50 levels total in game one plus another 50 in the sequel Super Karoshi. Some levels are easy (in fact, starting levels substitute the game tutorial) and some puzzles are really hard, annoying at times. Anyway, the game is harder than you think in the beginning. But it is enjoyable, also, this is the kind of game that you'll definitely want to share with your friends.

Pillage The Village

Do you remember PC game Black and White? A god simulator game developed by Lionhead Studios and published by EA Games. The game in which player assumes the role of god to control villages and even islands. Pillage the Village is kind of same but with exception that there is no pseudo AI in it like it is in Black and White. However, in Pillage the Village game there are certain kinds of RPG elements like talent builds. 3 Builds 1. Neutral, 2. Pacifist, 3. Antagonist. We'll talk about talents a little later. Now, more about the game: PTV is a ragdoll physics game with advanced gesture recognition, superb graphics (for flash platform) and awesome gameplay.

LOS ANGELES (Reuters) - When MTV's "Teen Wolf" heartthrob Dylan O'Brien first auditioned for young adult dystopian film "The Maze Runner," director Wes Ball thought he was too "cool" to play the movie's innocent, vulnerable lead.

"I wasn't even sure that Dylan was the right guy at first," Ball said with a laugh. "It took me a lot of time to talk to Dylan, to just get to know him and understand that he can do the very emotional, soft, nuanced stuff."

"Maze Runner," out in U.S. theaters on Friday, is based on the first novel in James Dashner's young adult series. It follows a group of boys with no memories of their past, living in an isolated, mysterious paradise called the Glade, trapped by a giant moving concrete maze that is their only escape.



It is also Twenty-First Century Fox's first film to be shown on a 270-degree panoramic screen called Barco Escape, which will be featured in five Cinemark movie theaters in Florida, Illinois, California and Texas.

The three-piece screens aim to immerse viewers into the film, from the claustrophobic elevator box that Thomas, played by O'Brien, travels to the Glade in, to a tense action scene when he tries to escape from the rapidly changing Maze.

A lot rests on the shoulders of 23-year-old O'Brien, a former teen YouTube star, as he plays Thomas in the first installment of a three-part franchise "Maze Runner."

"It's completely opposite to the themes of these kids having to compete against one another and kill one another," O'Brien said, comparing "Maze Runner" to young adult films such as "Hunger Games" and "Divergent."



"This is very much about these kids having to come together and survive."

Inspired by William Golding's 1954 novel "Lord of the Flies," Dashner hopes his story appeals to both young adults and adults with its contemporary sci-fi themes.

"It's refreshing to have the main character be a male for once, seems like there's been a lot of female leads," he said.

Made for $30 million and filmed in under two months, "Maze Runner" is Fox's attempt to grab a slice of the young adult film audience who are being reeled in by franchises.

But not all young adult book adaptations have successfully performed at the box office. Last year, "The Host," "The Mortal Instruments" and "Ender's Game" performed below expectations.

"The reason some of those movies didn't work is because they weren't adventurous," Ball said.

"Maze Runner" may escape the same fate, with U.S. opening weekend projections of $37 million. The director is already scouting locations for the sequel, which changes tone as characters become fugitives.

"This movie is about them deciding to take their lives into their own hands and risk death to find a way out of this prison they're in. The next film is a crazy journey and it's really about them finding their identity," said Ball, who made his feature film directing debut with "Maze Runner."
